Terms of Service

These Terms of Service apply to transport, delivery, hotshot and related services supplied by MAK Transport. Please read them carefully before submitting a booking.

1. About these Terms

These Terms of Service ("Terms") govern the provision of transport, delivery, collection, hotshot and related services by The Trustee for POPOSKI FAMILY TRUST, ABN 13 250 692 685, trading as MAK Transport ("MAK Transport", "we", "us" or "our").

"Customer", "you" and "your" mean the person or entity requesting, booking or paying for our services.

By submitting a booking, accepting a quotation, instructing us to perform a service, paying for a service, or selecting the website checkbox confirming acceptance of these Terms, you agree to be bound by these Terms.


2. Bookings and acceptance

Submission of an online booking request does not, by itself, guarantee that MAK Transport has accepted the job.

A booking remains subject to driver availability, vehicle availability, load suitability, route conditions, access requirements, safety requirements and any other relevant operational considerations.

We may contact you to clarify the booking, confirm pricing or request further information before accepting or performing the service.

We may reasonably decline a booking where we cannot safely, lawfully or reasonably perform the requested service.


3. Delivery service levels

Standard Delivery

Standard deliveries are generally completed within approximately 1–3 business days, subject to availability and circumstances affecting the job.

Urgent Same-Day

Urgent deliveries may be requested for the same day. Acceptance remains subject to driver, vehicle and route availability.

24/7 Hotshot

Immediate and after-hours hotshot requests must be arranged directly with MAK Transport by telephone.

Standard booking cut-off: To request the next available delivery day, Standard Delivery bookings should be made before the cut-off displayed by our booking system. Our current online booking rules use Perth, Western Australia time.

4. Customer responsibilities

You must provide complete and accurate information reasonably required for us to perform the service, including:

  • correct pickup and delivery addresses;
  • accurate contact names and telephone numbers;
  • an accurate description of the goods or freight;
  • accurate weight, quantity and dimensions where requested;
  • information about unusually long, heavy, fragile, valuable or difficult-to-handle items;
  • any relevant access restrictions, stairs, gates, loading requirements or site conditions; and
  • any information necessary for the safe and lawful transportation of the goods.

You are responsible for reasonable additional costs caused by materially incorrect or incomplete information supplied by you, where those costs were reasonably incurred in performing or attempting to perform the service.


5. Packaging and preparation of goods

Unless we have expressly agreed otherwise, the customer is responsible for ensuring goods are appropriately packaged, secured and prepared for transport.

Packaging should be appropriate having regard to the nature, weight, dimensions and fragility of the goods and the ordinary conditions associated with road transport.

You must notify us before collection if an item requires special handling.


6. Waiting time and detention

First 10 minutes included

The quoted delivery price includes up to 10 minutes of waiting time at the pickup location and up to 10 minutes at the delivery location.

Additional waiting: $3.00 per 5-minute interval

Where waiting exceeds the included period, additional detention charges may apply. Our driver tracking system may record arrival and departure/status times to assist in calculating detention.


7. Heavy items and additional assistance

If an item above 30 kg reasonably requires an additional person to safely load, unload or handle the item and that assistance was not included in the original booking, an additional labour fee of $45.00 may apply where MAK Transport arranges the additional assistance.

We may refuse to manually handle any item where doing so would create an unacceptable safety risk.


8. Failed deliveries and return journeys

If delivery cannot reasonably be completed for reasons outside MAK Transport's control, including an incorrect address, unavailable recipient, refusal of delivery, unsafe access or inability to obtain required instructions, we may contact the customer for further instructions.

Where the goods are required to be returned to the sender, the customer will be charged the applicable transport charge for the return journey.

Additional reasonable charges may also apply for waiting time, redirection or an additional delivery attempt where those services are requested or reasonably necessary.


9. Authority to Leave

Where you select or otherwise provide Authority to Leave ("ATL"), you authorise MAK Transport to leave the goods at the delivery location without obtaining a recipient signature, provided our driver considers there is a reasonably suitable place to leave them.

We may photograph the delivered goods and surrounding location as evidence of delivery.

We are not required to leave goods where the driver reasonably considers the location unsafe, unsuitable or inconsistent with the customer's instructions.

Subject to rights and remedies that cannot lawfully be excluded, MAK Transport is not responsible for loss, theft or damage occurring after goods have been delivered in accordance with a valid ATL instruction and left in the nominated or reasonably suitable location.


10. Additional charges

In addition to the agreed transport price, reasonable additional charges may apply where relevant to the service and disclosed or authorised as required, including for:

  • detention or waiting time;
  • return journeys;
  • additional delivery attempts;
  • redirection requested by the customer;
  • additional labour;
  • tolls or specifically incurred access charges;
  • restricted or difficult access;
  • incorrect addresses or booking information;
  • long carry distances; and
  • additional services requested after the original booking.

11. Pricing and payment

Prices may be provided by quotation, booking confirmation, invoice, online payment process or another written agreement between the customer and MAK Transport.

Unless otherwise agreed in writing, invoices are payable within 7 days of issue.

Where an invoice remains overdue, a reasonable late-payment administration fee of $45.00 may be charged where permitted by law and where the fee reflects costs associated with managing and recovering the overdue account.

The customer may also be responsible for reasonable third-party debt recovery or legal costs actually incurred by MAK Transport in recovering an overdue amount, to the extent permitted by law.

Nothing in this clause requires the customer to pay an amount that cannot lawfully be charged or recovered.


12. Card payments and additional authorised charges

Where card payment is available, payment processing may be provided by a third-party payment processor. MAK Transport does not need to store the customer's complete payment card number on its own systems.

We will not make an additional card charge merely because a card was previously used for a booking. Any subsequent charge must be authorised under the payment arrangement or otherwise authorised by the customer and must relate to an amount properly payable for the service.

Business customers approved for account billing may instead receive invoices in accordance with their agreed account terms.


13. Cancellations and changes

Please contact MAK Transport as soon as possible if a booking needs to be cancelled, postponed or changed.

Where a cancellation or material change occurs after a driver has been dispatched, arrived at the pickup location or incurred costs specifically for the job, the customer may be required to pay the reasonable costs already incurred.

Any cancellation charge will have regard to the work performed and costs reasonably incurred rather than operating as a penalty.


14. Dangerous, hazardous and prohibited goods

Dangerous, hazardous, regulated or unusually risky goods must be disclosed to MAK Transport before the booking is accepted.

You must provide any classification, documentation, packaging, labelling or handling information required by applicable law.

MAK Transport may refuse goods that we are not equipped, authorised or willing to transport.

You must not knowingly provide illegal goods or goods whose possession or transportation would contravene applicable law.


15. Live delivery tracking

MAK Transport may provide customers with a private tracking link showing delivery status and, while tracking is active, an approximate vehicle location.

Tracking information is provided for convenience and may be delayed, interrupted or temporarily unavailable due to mobile coverage, GPS accuracy, device settings, internet connectivity or technical issues.

A location shown on the tracking page should not be treated as a guaranteed arrival time.

Customer tracking links are intended for the customer and authorised recipients and should not be published publicly.


16. Proof of delivery

MAK Transport may record reasonable proof of collection or delivery, including status timestamps, photographs, recipient names, signatures, delivery notes and other relevant delivery records.


17. Delays and events outside reasonable control

Delivery times and estimates may be affected by circumstances outside our reasonable control, including traffic incidents, road closures, severe weather, emergencies, breakdowns, government restrictions, site delays or other unexpected events.

Where such an event occurs, MAK Transport will take reasonable steps in the circumstances to communicate material delays and complete the service.


18. Loss, damage and liability

Customers should notify MAK Transport as soon as reasonably practicable after becoming aware of alleged loss or damage relating to a service and provide reasonable supporting information.

To the extent permitted by law, MAK Transport is not responsible for loss or damage to the extent it was caused or contributed to by:

  • inadequate packaging by the customer;
  • inaccurate or incomplete information supplied by the customer;
  • an inherent defect or characteristic of the goods;
  • an unsafe or unsuitable condition not caused by MAK Transport;
  • lawful compliance with the customer's specific instructions; or
  • acts or omissions of the customer, sender, recipient or another person outside MAK Transport's control.

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.


19. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify rights or remedies available under the Australian Consumer Law or any other law where those rights or remedies cannot lawfully be excluded, restricted or modified.

Different statutory rules may apply depending on the nature of the customer, the goods and the service.


20. Personal information and delivery information

We may collect and use information reasonably necessary to arrange and perform transport services, administer customer accounts, communicate about bookings, process payments, provide tracking and maintain delivery records.

This may include customer and recipient names, telephone numbers, email addresses, pickup and delivery addresses, booking details, tracking information and proof-of-delivery records.

Customers should only provide another person's contact details where they are authorised or otherwise permitted to do so for the purpose of arranging the delivery.


21. Drivers and subcontractors

MAK Transport may use employees, drivers, contractors or other appropriately engaged service providers to assist in performing a booking. MAK Transport remains subject to obligations imposed on it by applicable law.


22. Changes to these Terms

MAK Transport may update these Terms from time to time for future bookings.

Unless otherwise agreed or required by law, the version accepted in connection with a booking will apply to that booking. Updating the website Terms does not retrospectively replace the agreed Terms for an existing booking merely because a newer version is published.


23. Severability

If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision is to be treated as ineffective to the extent necessary, and the remaining provisions continue to operate to the extent permitted by law.


24. Disputes

If a dispute arises, the customer should first contact MAK Transport and provide reasonable details of the issue so that both parties have an opportunity to attempt to resolve the matter.

Nothing in this clause prevents either party from exercising a right to seek urgent relief or using any dispute resolution process or remedy available under applicable law.


25. Governing law

These Terms are governed by the laws applicable in Western Australia, Australia. Subject to any rights a party has under applicable law to bring proceedings elsewhere, the parties submit to the jurisdiction of the courts of Western Australia and courts having appellate jurisdiction from them.
